Violating these provisions may result in immediate termination of your access to the Services and, where applicable, legal action.

Energy Shepherd reserves the right to modify, suspend, or discontinue any aspect of the Services at any time without notice. We are not liable to you or any third party for changes to the Services or interruptions in access.

8. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied. Energy Shepherd disclaims all warranties, including but not limited to:

  2. Non-infringement of intellectual property.
  3. Accuracy, completeness, or reliability of content.

We do not guarantee uninterrupted, error-free, or secure access to the Services.

9. Limitation of Liability

To the fullest extent permitted by law, Energy Shepherd shall not be liable for:

  1. Indirect, incidental, punitive, or consequential damages arising from the use of the Services.
  2. Loss of data, revenue, or profits due to service interruptions.

Specific Terms of Service and Conditions

These Specific Terms and Conditions (“Specific Terms”) outline additional provisions and guidelines specific to the unique features, services, products, and functionalities provided by Energy Shepherd. These terms supplement and are subject to the General Terms and Conditions. By engaging with these specific services, you agree to be bound by these Specific Terms.

1. Purpose of Specific Terms

The Specific Terms are designed to address the features, tools, and methodologies unique to Energy Shepherd, ensuring clarity, transparency, and alignment in their usage. These provisions govern access to:

  1. Membership Levels and progression criteria.
  2. Planning Tool and Contribution Methodology functionalities.
  3. Empower App and Value Exchange System participation.
  4. Alignment Processes and self-assessment tools.
  5. Intellectual property related to proprietary methodologies, such as NBL Engineering and CPPI.

2. Membership Levels

Energy Shepherd offers five membership levels. Each level carries unique privileges, obligations, and responsibilities:

  1. Candidate:
    • Entry-level access to introductory resources and foundational materials.
    • No access to the Empower App or advanced tools.
  2. Aligned Participant:
    • Access to the Trait Quiz and self-assessment tools.
    • Continued exploration of alignment with Energy Shepherd’s mission.
  3. Client:
    • Full collaboration, access to 3/5ths of the Planning Tool, and Empower App privileges (give and receive funds anonymously).
  4. Potential Shepherd:
    • Advanced access to 4/5ths of the Planning Tool, leadership preparation, and deeper engagement with Energy Shepherd’s mission.
  5. Shepherd:
    • Full access to the Planning Tool and Empower App.
    • Leadership roles and the ability to guide and inspire other members.

Membership progression is determined by alignment, engagement, and contribution to Energy Shepherd’s mission. Energy Shepherd reserves the right to modify membership privileges or revoke access at its discretion.

3. Planning Tool and Contribution Methodology

Planning Tool

The Planning Tool is a core feature of Energy Shepherd designed to:

  • Define goals and align actions with purpose.
  • Evaluate resources and energy required to achieve objectives.
  • Track measurable progress toward meaningful outcomes.

Contribution Methodology

  1. Obligations:
    • Contributions defined via the Quote Development Tool are binding and enforceable.
    • Includes financial payments, trade/barter agreements, and profit-sharing structures.
  2. Voluntary Contributions:
    • Enabled through the Empower App for secure, anonymous value exchange.
    • Contributions reflect intentional alignment and are not obligatory.

Misuse of the Planning Tool or Contribution Methodology will result in immediate suspension of access to these features.

4. Empower App

The Empower App is a revolutionary value exchange system enabling anonymous contributions. Access and participation are governed by membership levels:

  1. Level 1 (Candidate):
    • Contributions are limited to Energy Shepherd as a whole.
  2. Level 3 (Client) and Above:
    • Full participation in giving and receiving contributions.
    • Contributions remain anonymous and cannot be earmarked for specific individuals or purposes.

Prohibited Actions:

  • Attempting to circumvent anonymity features.
  • Engaging in unauthorized transactions or fraudulent activity.

5. Alignment Processes

Energy Shepherd’s Alignment Methodology includes self-assessment tools and guided evaluations:

  1. Trait Quiz:
    • Available at the Aligned Participant level to assess alignment readiness.
  2. Alignment Questions and Levels:
    • Designed to help users evaluate their alignment with Energy Shepherd’s mission and values.

Misrepresentation during alignment assessments may result in restricted access to advanced tools and services.

6. Proprietary Methodologies

Energy Shepherd’s proprietary methodologies, including NBL Engineering (Neurobiological Engineering) and CPPI (Continuous Product and Process Improvement), are protected intellectual property. Users accessing materials related to these methodologies agree to:

  1. Use the content solely for personal or organizational growth within the scope of Energy Shepherd’s mission.
  2. Refrain from sharing, distributing, or reproducing proprietary content without prior written consent.

7. Specific Use Restrictions

The following restrictions apply to the unique features of Energy Shepherd:

  1. Video Content and Tools:
    • Videos, training materials, and interactive tools are for educational purposes only. Unauthorized copying or distribution is prohibited.
  2. Interactive Elements:
    • Clickable components, such as the Planning Tool and Empower App, must not be tampered with or reverse-engineered.
  3. Data Collection and Use:
    • Any data collected through Energy Shepherd’s tools may only be used within the context of its services and must comply with all applicable privacy regulations.

8. Fees and Payment Terms

Specific services, such as access to advanced tools and training, may require payment or subscription fees as outlined upfront during the Quote Development Process. By engaging with these services, you agree to:

  1. Pay all applicable fees as outlined during the Quote Development Process.
  2. Adhere to refund policies as outlined in the Quote Development Process and Contribution Methodology, which may vary based on the services, goods, tools, or solutions provided.

Failure to remit payments will result in suspension of access to the affected services.

9. Limitation of Liability for Specific Features

Energy Shepherd is not responsible for:

  1. Errors arising from misuse of tools such as the Planning Tool or Empower App.
  2. Losses incurred due to misalignment with Contribution Methodology guidelines.
  3. Unintended outcomes from self-assessment or alignment processes.

10. Age Restrictions for Specific Features

Some features, such as membership progression beyond Level 1 or access to the Empower App, require users to be 18 years or older. Users under 18 may access introductory resources with parental or guardian consent but are prohibited from accessing advanced tools or making contributions.

11. Updates to Specific Terms

Energy Shepherd reserves the right to update these Specific Terms at any time. Changes will be communicated via the website or email and are effective immediately upon posting.

12. Dispute Resolution

Disputes related to Specific Terms will follow the dispute resolution procedures outlined in the General Terms and Conditions.
